Privacy Policy
Effective 1 August 2026 · macrodark LLC · Florida, United States
This policy says what macrodark LLC (“macrodark,” “we”) does with personal information. It covers this website, Studio work, and the Service: the self-serve product on macrodark.com, including the editor, Superintelligence, hosted video, Widgets & Plugins, and the Marketplace.
It is not legal advice. It does not cover a site a customer publishes. Visitors to that site are the customer’s. The customer’s own privacy policy applies to them, unless a statement of work (“SOW”) says we host that data as part of the job.
The Terms of Service are part of the same contract. A word defined there has the same meaning here.
1. Two roles
On the account, the billing, and this website, we decide why the data is used. We are the business that collected it.
On a site the customer builds, the customer decides why visitor data is used. We host and process it to provide the Service. We do not use a customer’s visitor list for our own ads. We do not sell it.
2. Age, truth, and verification
The Service and Studio are for people 18 or older. We do not seek personal information from anyone under 18. Do not open an account, send a brief, pay, or give us data if you are under 18.
You represent, each time you give us data and each time you pay, that:
- you are 18 or older;
- the name, email, phone, company, and billing details are true;
- you have authority to bind the account and, if you name one, the organization;
- you will not use the Service to collect personal information from anyone under 18.
Those statements are a condition of the account and of every charge. We may check them in layers, before we take money and again before a higher-risk use:
- Express confirmation at signup, next to the pay button, that you are 18 or older and that the account data is true.
- Control of the email, and of the phone if we ask for it.
- A payment method whose billing name matches the account, before the plan charge.
- A further check before a Marketplace payout, a voice job, or any use we mark as requiring it.
We keep the record of the confirmation and of the check. We may refuse the account, the charge, or the payout if a layer fails. No layer is a promise that we will catch every false statement.
If we learn that we hold personal information from someone under 18, we delete it and close the account.
3. What we collect
Account and billing. Name, email, password, company, billing address, the plan, and the verification record in section 2. Card numbers go to the payment processor. We do not store the full card number. We keep the last four, the brand, the expiry month, and the processor’s customer id, if the processor sends them.
Studio. What you put on a form or in a brief: name, email, phone, company, message, and the service you selected. WhatsApp or a call, if you start one.
Service content. Pages, images, files, database records, Widgets & Plugins, and video you upload. Prompts and outputs you send through Superintelligence.
Technical. IP address, browser, pages viewed, device type, date and time, and a Cloudflare Turnstile token to block bots. Language: from your country when that language is on this site, otherwise from the browser, otherwise English. A manual pick is stored as macrodark-locale.
Video and voice. If an SOW includes the voice desk, the script, the hours, and a recording if the job records calls. You are the caller of record. Florida and the carrier rules on consent are yours.
We do not ask for a government id unless a verification layer in section 2 requires it. We do not buy lists.
4. Why we use it
To decide if we can open the account, to take payment, to run the plan, and to answer a quote. To host the site, count tokens, store video, and deliver a Widget or Plugin the customer bought. To test the statements in section 2, to block abuse, to keep tax and invoice records, and to defend a claim.
Superintelligence sends the prompt to a model provider, including xAI, to return the output. Do not put a secret in a prompt if you need it kept off a third-party model.
Where a statute asks for a basis: the contract, a legal duty, and the ordinary running of the Service. A marketing email only goes if you ask for it, and you can stop it in the message.
5. Who sees it
Operators of macrodark. Processors that host the Service, send email, run DNS, serve the captcha, or run a verification check, including Cloudflare. The payment processor that charges the plan. The model provider that runs Superintelligence. WhatsApp and the telephone network, if you use those buttons. A buyer of a Widget or Plugin sees the listing you publish, not your account data.
We do not sell personal information. We do not share it for cross-context behavioral advertising. That is the “sale” and “share” those words have in US state privacy statutes.
We disclose data if the law requires it, to enforce the Terms, or to defend a claim.
6. How long we keep it
A lead that never became a contract: as long as we need to reply, then a reasonable archive, unless you ask us to delete it and no exception below applies.
Account and sites: for the paid period. If you close the account, the site, Widgets & Plugins, and purchases stay 30 days, then we delete them, on the same terms as the Terms of Service. An export before that deletion is content you uploaded, not the CMS.
The verification record, the consent to the charge, invoices, and tax records: at least as long as a tax rule, a chargeback window, or a claim requires, and for three years after the contract ends where a renewal statute requires the consent record.
Backups die on the backup cycle after deletion. A deleted video extra is not kept, as the Terms say. We may keep a record that we deleted data from someone under 18, without keeping the data.
7. False statements and refunds
This section is shown before you pay. It applies in every state, except where a statute of that state does not allow the result.
A false statement in section 2, or any other material false statement in the account, is a breach. If we confirm it, we may suspend the account at once, delete the content, and keep the plan fee for the period already started and any extra already bought.
We keep those amounts because the charge was made in reliance on your statement, and because the Service was made available. Closing the account, not using tokens, or saying afterward that the statement was false does not create a refund.
We still refund, in every state: a charge made after a cancellation we received before the renewal; a duplicate charge; a charge for a plan or an extra we never made available; the unearned part of a fee where a statute of your state, including a minor’s right to disaffirm a contract, does not allow us to keep it; any other amount a statute of your state does not allow us to keep.
A person who was under 18 when the account was opened had no right to open it. Discovery of that fact is not a customer refund right beyond what that person’s state requires. Where that state lets us keep the reasonable value of what was already used, we keep it.
8. Security
Ordinary commercial care. Access is limited to operators who need it. No method is perfect. Do not send a password or a card number through the public form.
9. Requests
Email the address on the account or the quote, or use the contact page. You may ask what we hold, ask for a correction, or ask us to delete a lead or an account. We respond within 45 days. We may keep what a tax rule, a chargeback, a verification record, or a legal claim requires. A deletion request is not a refund.
If a state privacy law applies to us and to you, you may also appeal a refusal, and you may opt out of a sale or a share. We do not sell or share, so that opt-out has nothing to act on. We do not use sensitive data to infer a trait for advertising.
Most state privacy laws apply only after a revenue or a volume threshold. We honor a request in this section whether or not a threshold is met.
10. Changes
We post updates on this page with a new effective date. A material change to how we use account data is also noticed in the account before it applies.
